Ten years in the making, patent reform is getting close to becoming law. The Leahy-Smith America Invents Act (HR 1249) imposes a fundamental change in US patent law. The House approved the bill in June, and the Senate passed the bill by an 89-9 margin on September 8. Currently, the US awards on a "first-to-invent" basis. The most important piece of the new legislation would change awards to a "first-to-file" basis.
