[South Africa] Glassmakers Accused Of Cullet Price-Fixing

Consol and Nampak, South Africa's main glass container manufacturers, have been referred to the country's Competition Tribunal for alleged collusion in the purchase of cullet and could be fined 10% of their turnovers as a result. This follows a complaint by the recycling firm Enviroglass, alleging that price fixing and market allocation arrangements were being made by the two glassmakers. An investigation by the Commission found that Consol and Nampak "Fixed prices in respect of their purchases of cullet to reduce prices"; and, "Refused to negotiate cullet prices outside GRA". Consol disagrees with the findings, and says it will defend the case. Nampak said it was surprised the complaint had arisen at a time of great progress with glass recycling initiatives. Meanwhile, Consol has announced proposals to expand into other parts of Africa by acquisitions.
