Proposition 65 Deadline "Opt In" Extension

The deadline for defendants to "opt-in" to the 18/08/05 Proposition 65 settlement between plaintiff Russell Brimer & The Boelter Companies has been extended to 31/03/06. There have been approximately 260 Proposition 65 notices related to glass & ceramicware filed since the August 2005 settlement, & a large number of these allegations remain to be either settled or litigated. Although there is no official state warning threshold for non-food contact surfaces of glass & ceramicware, Proposition 65 warnings are an option for companies to establish a defense against allegations that ware exposes consumers in California to lead or cadmium. There have been 55 actual lawsuits filed in San Francisco Superior Court for plaintiffs Russell Brimer and Whitney Leeman since late October related to Proposition 65 notices alleging lead exposure from glass & ceramicware. In 2005, Brimer served 349 Proposition 65 notices, filed 87 cases, and reached 25 Proposition 65 settlements, while Whitney Leeman served 45 Proposition 65 notices, filed 23 cases, and reached 9 Proposition 65 settlements.
