Thermoseal Group Ltd, has been fined £10,000 & ordered to pay costs for falling foul of the Producer Responsibility Obligations (Packaging Waste) Regs 1997. The Environment Agency brought the charges. The Birmingham-based firm pleaded guilty to 5 charges relating to failing to meet obligations concerning the recycling & reuse of packaging. The EA wrote to Thermoseal in Nov/04 saying that it was likely the Group was an obligated company. Investigations indicated that it should have registered in 2001/2/3 & 4 & had failed to do so. It had also failed to take reasonable steps to recover & recycle packaging in the 4 years & to submit a certificate indicating compliance for those years. In mitigation, Andrew Stacey told the court that his clients had pleaded guilty, that the firm had an unblemished environmental record & was not aware it would be caught by the regulations.
